Concierge Terms

In addition to providing expense management software, invoicing, bill processing, applications and other related financial tools and services, Expensify, Inc. (Expensify”, “we”, “us”, or “our” which include our group and affiliated companies), connects those Members who also hold Cards (“Cardholders” and each, a “Cardholder”) or Corporate Administrators with a Virtual Personal Assistant to aid in expense and business needs, including booking travel, along with other related features provided by Expensify from time to time, subject to certain conditions and restrictions via the Concierge chat feature (“Concierge”, as described in more detail herein). Please read carefully the following terms and conditions related to Concierge (the “Concierge Terms”).  By participating in Concierge, you acknowledge that you have read these Concierge Terms and agree to abide by the requirements explained herein. These Concierge Terms are incorporated into the Expensify Terms of Service. These Concierge Terms govern your access to and use of Concierge and constitute a binding legal agreement between you and Expensify.

In these Concierge Terms, “you” and “your” refers to the Cardholders and Corporate Administrators of the Expensify Service accessing Concierge and/or booking a reservation through Concierge. As a condition of your use of Concierge, you warrant that:

  • You will only use Concierge to make legitimate reservations for you or for another person for whom you are legally authorized to act (a “Traveler”);

  • You will inform such other persons about the Concierge Terms that apply to the reservations you have made on their behalf, including all rules and restrictions applicable thereto; and

  • You will safeguard your Account information and will supervise and be completely responsible for any use of your Account by you and anyone other than you.

Capitalized terms not defined in these Concierge Terms are defined in the Expensify Terms of Service.

YOU ACKNOWLEDGE AND AGREE THAT, BY CLICKING ON THE “ACCEPT TERMS” BUTTON, OR PARTICIPATING IN CONCIERGE, YOU ARE INDICATING THAT YOU HAVE READ, UNDERSTAND AND AGREE TO BE BOUND BY THESE CONCIERGE TERMS. IF YOU DO NOT AGREE TO THESE CONCIERGE TERMS, THEN YOU HAVE NO RIGHT TO PARTICIPATE IN CONCIERGE. If you accept or agree to these Concierge Terms on behalf of a company or other legal entity, then you represent and warrant that you have the authority to bind that company or other legal entity to these Concierge Terms and, in such event, “you” and “your” will refer and apply to that company or other legal entity.

Expensify reserves the right, at its sole discretion, to modify, discontinue or terminate Concierge or to modify these Concierge Terms, at any time and without prior notice. If we modify these Concierge Terms, we will post the modification on www.expensify.com (the “Site”) or provide you with notice of the modification. We will also update the “Last Updated Date” at the top of these Concierge Terms. By continuing to participate in Concierge after we have posted a modification on the Site or have provided you with notice of a modification, you are indicating that you agree to be bound by the modified Concierge Terms. If the modified Concierge Terms are not acceptable to you, your only recourse is to cease participating in Concierge.

1. Definitions

  • Concierge” is a component of Expensify’s Services whereby you may secure Virtual Assistant Services via email or the chat feature in your Account.

  • “Concierge AI” means any feature(s) or functionality made available by Expensify that utilize(s) data models trained by machine learning.

  • “Suppliers” means any third-party providers of Virtual Assistant Services, including but not limited to, OpenAI, L.L.C.

  • “Travel Service” and/or “Travel Services” means travel reservations, which may include airfare, including add-ons to airfare purchases; ground transportation, including car rentals and rideshare services; accommodations, including hotel rooms, room sharing, resorts, or other lodgings; travel planning, including consultation and logistics; trip insurance and any other travel or travel related products for business-related travel only.

  • “Trip” means any Travel Service, or package of Travel Services booked by Expensify or Suppliers for you.

  • Virtual Assistant Service” and/or “Virtual Assistant Services” means the services that your Virtual Personal Assistant can provide to you for your business needs, including Travel Services.

  • “Virtual Personal Assistant” is your personal business coordinator, available to help you book Virtual Assistant Services via the Application or email, and may. include use of Concierge AI.

2. Travel Services

Through Concierge, you may request Travel Services from Expensify or its Suppliers. In order to facilitate the purchase of Travel Services by you, you agree to authorize Expensify or its agents or Suppliers to submit certain information, including the name, date of birth, passport details, airline frequent flyer number, airline preferences, airport preferences, seating preferences, hotel preferences, car rental preferences and other personal information of the Traveler and the applicable payment information (collectively, the “Shared Information”), to the Supplier. As an example, and by way of illustration only: to facilitate a Cardholder’s purchase of an airline ticket, Expensify or its Suppliers may provide the Cardholder’s name, frequent flyer number, phone number, email address, preferred seat, other identifying information, and payment information to the airline.  Similar information would be provided for the purchase of a hotel room or a car rental.

Expensify is not responsible for the provision of Travel Services and does not guarantee the correctness of any material, information or results made available to you by or from Suppliers, and the presentation of travel inventory through Concierge does not constitute a binding contract offer by Expensify or the respective Supplier. You, as applicable, acknowledge and agree that (i) the purchase of Travel Services may be subject to the terms and conditions, agreements (such as contract of carriage), and privacy and security policies of the specific Supplier selected by your Virtual Personal Assistant, and (ii) the use of Travel Services will be subject to your compliance with applicable law. You shall be solely responsible for, and assume all risk arising from, the selection, use and receipt of any Travel Service. You shall be responsible for the accuracy of all Shared Information you provide to Expensify.

Expensify shall not be liable for the performance of any Travel Service, any loss or injury to any person resulting from a Travel Service, or any unauthorized use, disclosure, or misuse of any Shared Information by a Supplier.

3. Input and Output

You may provide input to be processed by Concierge AI (“Input”), and receive output generated and returned by Concierge AI based on the Input (“Output”). When you use Concierge AI, Input and Output are your Member-Generated Content. You are solely responsible for the development, content, operation, maintenance, and use of your Member-Generated Content. You will ensure that your Input and use of Concierge AI and Output will not (i) violate any applicable law; (ii) violate these Concierge Terms, the Expensify Terms, or our Privacy Policy, or (iii) infringe, violate, or misappropriate any of our rights or the rights of any third party. You acknowledge that due to the nature of machine learning and the technology powering Concierge AI features, Output may not be unique and Concierge AI may generate the same or similar output to Expensify or a third party.

4. Prices and Surcharges

Concierge is only available to Cardholders and Corporate Administrators.  Such Cardholders and/or Corporate Administrators may use only the Card to make purchases and reservations via Concierge. 

Only items and fees explicitly advertised as included in the price of a Virtual Assistant Service will be included as part of Virtual Assistant Service’s quoted price. We use commercially reasonable endeavors to provide accurate prices and information for Virtual Assistant Services in Concierge and through our agents. Suppliers provide us with the price, availability and other information related to these Virtual Assistant Services. In the event, however, that a Virtual Assistant Service is listed or provided to us at an incorrect price or with incorrect information due to typographical error or other error in pricing or service information received from a Supplier, we retain the right to refuse or cancel any Trip or reservation, whether or not the order has been confirmed and/or your Card charged. If your Card has already been charged by the Supplier for the purchase and your Trip or reservation is canceled because of incorrect hotel, airline, or car provider information, we will use commercially reasonable efforts to request a reversal to your Card in the amount of the charge from the Supplier.

We expressly reserve the right to correct any pricing errors quoted in Concierge and/or on pending reservations made under an incorrect price. In such event, if available, we will offer you the opportunity to keep your pending reservation at the correct price or we will use commercially reasonable efforts to request a credit to your Card in the amount of the charge from the Supplier and cancel your reservation.  Under no circumstances does Expensify guarantee that it will be able to obtain any reservation cancellations or credits to your Card from Suppliers and any failure to do so will remain your liability.

No claim relating to the price of a Trip or reservation will be considered once the Trip or reservation has started. All prices are quoted in US dollars (US$), unless otherwise specified.

5. Taxes 

Unless otherwise noted, and only as applicable, all amounts and fees stated or referred to in these Concierge Terms or quoted via the Virtual Assistant Services, are exclusive of taxes, duties, levies, tariffs, and other governmental charges (including, without limitation, VAT) (collectively, “Taxes”). You shall be responsible for payment of all Taxes and any related interest and/or penalties resulting from any Fees, other than any taxes based on Expensify’s net income. With respect to Taxes charged on or applicable to the purchase or sale of Travel Services, Expensify shall reflect such Taxes in invoices and/or in the reporting available to you on the Site, and you shall be responsible for the payment of all such Taxes.

6. Reservations/Bookings 

To make a reservation with Expensify, please use the Concierge chat feature within your Account or contact us directly at concierge@expensify.com.

7. Payment Methods

Currently, payment for Virtual Assistant Services may only be made through the Card by Cardholders or Corporate Administrators.

8. Cancellation, Substitution, and Alteration Policies

Cancellations, Substitutions, and Alterations Attributable to You

If you use the Virtual Personal Assistant to book any Virtual Assistant Services, you are authorizing the Virtual Personal Assistant to act as your agent in any such Virtual Assistant Services performed on your behalf and at your behest.  Any cancellation or change fees will be your responsibility alone, except as otherwise set forth herein.

Cancellation, substitution, and/or alteration terms vary by Supplier. It is your responsibility to familiarize yourself with the applicable Supplier’s terms prior to purchase, so we urge you to read such terms carefully.

If available by the Supplier, you may cancel or change your Travel Services, but you will be charged the cancellation or change fee indicated in the rules and restrictions for the Trip reservation. If you do not cancel or change your reservation before the cancellation policy period applicable to your Travel Services prior to the date of your Trip, you may be subject to a charge equal to applicable rates, tax recovery charges and service fees or airline fees. In the case of a hotel reservation, in the event you do not show for the first night of the reservation and plan to check-in for subsequent nights in your reservation, you must confirm the reservation changes with us no later than the date of the first night of the reservation to prevent cancellation of your reservation.

You agree to pay any cancellation or change fees that you incur. In some cases, some hotels, rental agencies, airlines, and other Suppliers do not permit changes to or cancellations of reservations immediately after they are made, as indicated in the rules and restrictions for the Trip or reservation. You agree to abide by any Supplier terms and conditions imposed with respect to your Trip or reservation.

Cancellations and/or Alterations Not Attributable to Cardholder

Particularly as a result of causes beyond our control (i.e. weather and travel conditions, river water levels, political or environmental changes, pandemics or epidemics, national security risks, acts of terror, equipment failure, flight schedule changes or rescheduling of air routes and times, referred to herein jointly as ”Force Majeure”), changes and/or cancellations may need to be made to confirmed bookings. While we will endeavor to avoid changes and cancellations, we must reserve the right to do so and to substitute alternative arrangements of comparable monetary value. Expensify reserves the right to adjust the Travel Service or change the modes of ground and air travel, change the quality of accommodations or otherwise change the Travel Service without prior notice. We accept no liability for loss of enjoyment as a result of these changes.  Any additional charges incurred arising from the postponement, delay or extension of a Trip or adjustment to the itinerary due to Force Majeure will be your responsibility. Expensify will attempt to provide you advanced notice of any changes to a Trip or reservation to the extent commercially possible.

9. Issuing Travel Documents

Travel documents will only be sent to (i) the purchasing Cardholder or Corporate Administrator who places the order and (ii) the Traveler, each of whom shall explicitly agree to the Concierge Terms. Should the Traveler change his or her email address, phone number, or address before his or her departure date, you are required to advise us of the change. If you provide incorrect information to Expensify, we do not assume any liability if the Trip is adversely affected or made impossible by the non-receipt of travel documents.

10. Cardholders with Special Needs or Disabilities

If the Traveler has special needs (e.g., wheelchair accessible room, traveling with seeing eye dog, etc.) you must call all relevant Suppliers for the Trip or confirmed booking ahead of time and verify that special needs can be met. Depending on such Supplier’s terms and conditions, your reservation may be refunded, canceled or modified if special needs cannot be met. Expensify makes no guarantee as to the ability of any Supplier to meet special needs.

11. Insurance and Travel Support

Should you have to cancel a Trip because of illness, injury or death to the Traveler or an immediate family member, depending on the type of coverage purchased, Trip cancellation insurance may protect some or all deposits and payments for both air and Trip costs. Trip cancellation and interruption penalties can be significant. Purchasing Trip cancellation insurance at a much later date may limit some of the coverage as to pre-existing or other conditions. It is your responsibility to understand the limitations of any insurance coverage and purchase additional insurance as needed.  It is your sole responsibility to research, evaluate and purchase appropriate coverage, but Concierge may be able to help you in purchasing such Trip insurance coverage. You agree that Expensify is not responsible for any uninsured losses.  Expensify has also partnered with Global Rescue LLC (“Global Rescue”) for domestic and international travel advisory services and international travel security services at no charge to you for any Trips completed in accordance with these Concierge Terms.  You acknowledge, however, that if Expensify’s partnership with Global Rescue ends for any reason, you will no longer have access to Global Rescue for any Trips not completed as of the termination date.  For more information on the advisory and security services provided by Global Rescue, please visit Global Rescue directly.

12. Passports, Visas, Reciprocity Fees, and Travel Health Requirements 

It is your sole responsibility to verify that you have all the necessary visas, transit visas, passport, and vaccinations required for the Traveler prior to travel and have paid any required reciprocity fees for the destination. A full and valid passport is required for all persons traveling to any destination outside the U.S.  Traveler must obtain and have possession of a valid passport, all visas, permits and certificates, and vaccination certificates required for Traveler’s entire Trip.

Most international Trips require a passport valid until at least six (6) months beyond the scheduled end of your Itinerary.  Non-U.S. citizens should contact the appropriate consular office for any requirements pertaining to their Trip.  Further information on entry requirements can be obtained from the State Department, by phone (202) 647-5335 or at the State Department’s website or directly from the destination country’s website.

Some countries require you to be in possession of a return ticket or exit ticket and have sufficient funds, etc.  Similarly, certain countries require that the Cardholder produce evidence of insurance/repatriation coverage before it will issue a visa.

You must carefully observe all applicable formalities and ensure that the full names used for all passengers when making a booking and appearing in your travel documents (booking forms, travel tickets, vouchers, etc.), correspond exactly with those appearing on Traveler’s passport, visas, etc

Immunization requirements vary from country to country and even region to region.  Up-to date information should be obtained from your local health department and consulate.  You assume complete and full responsibility for, and hereby release Expensify from, any duty of checking and verifying vaccination or other entry requirements of each destination, as well as all safety and security conditions of such destinations during the length of the proposed travel or extensions expected or unexpected.  For State Department information about conditions abroad that may affect travel safety and security, you can contact them by phone at (202) 647-5335. For foreign health requirements and dangers, contact the U.S. Centers for Disease Control (CDC) at (404) 332-4559, use their fax information service at (404) 332-4565, or go to the CDC travel website.

It is your responsibility to ensure that Traveler holds the correct, valid documents for the countries Traveler is visiting and have obtained the necessary vaccinations, clearance to travel, and hold the necessary confirmations for medications required as we cannot be held liable for any illness, delays, compensation, claims and costs resulting from your failure to meet these requirements.

WE CANNOT ACCEPT RESPONSIBILITY IF TRAVELER IS REFUSED PASSAGE ON ANY AIRLINE, TRANSPORT OR ENTRY INTO ANY COUNTRY DUE TO THE FAILURE ON YOUR PART TO CARRY OR OBTAIN THE CORRECT DOCUMENTATION. IF FAILURE TO DO SO RESULTS IN FINES, SURCHARGES, CLAIMS, FINANCIAL DEMANDS OR OTHER FINANCIAL PENALTIES BEING IMPOSED ON US, YOU WILL BE RESPONSIBLE FOR INDEMNIFYING AND REIMBURSING EXPENSIFY ACCORDINGLY.

13. Accommodations 

Accommodations” are any lodgings in a dwelling or similar living quarters booked for you including, but not limited to, hotels, short term apartments, room or couch shares, motels, and resorts.  Expensify provides the accommodations for its Trips through Suppliers and retains no ownership or management interest in those Accommodations. Expensify does not guarantee the location or the amenities of the Accommodations nor the performance of the third-party Supplier.  If any issues arise, please contact the owner/operators of the respective Accommodations directly.

Accommodations and living standards may vary from country to country and region to region. Expensify makes no guarantees about Accommodation living standards. Any additional costs, i.e. upgrades etc., will be borne by you.

Prices of Accommodations are based on double occupancy unless described otherwise.  If you prefer single Accommodations, some Accommodations require you to pay a single supplement fee which can vary depending on the Accommodation.

14. Air Transport

General conditions governing air transport

Expensify’s responsibilities with respect to air travel are limited by the relevant airline’s Contract of Carriage.  All airline Contracts of Carriage are available for view publicly on their websites and at their office branches.   Expensify is not able to specify the type of aircraft to be used by any airline or guarantee seat assignments.  In addition, Expensify is not responsible for losses due to cancelled flights, seats, or changed flight itineraries.  Airlines retain the right to adjust flight times and schedules at any time, and these changes may include a change in the airline you fly, your aircraft type or destination.  Such alterations do not constitute a significant change to your Trip Itinerary. If an airline cancels or delays a flight, you should work with the airline to ensure Traveler arrives at the destination on or ahead of time. Expensify will not provide any refund for Trips missed, in part or full, due to missed, cancelled or delayed flights, or other flight irregularities including, without limitation, denied boarding whether or not you are responsible for such denial.  Airline flights may be overbooked. A person denied boarding on a flight may be entitled to a compensatory payment or other benefits from the airline.  The rules for denied boarding are available at all ticket counters in your Contract of Carriage.

Flight Times

The flight times given by Expensify are for general guidance only and are subject to change. Up-to-date flight times will be shown on the tickets. You must check the tickets very carefully immediately upon receipt of the latest timings.

Failure to Check-in

Failure to check-in for a flight on the outward journey (on a charter or scheduled flight) will automatically result in cancellation of the return flight by the airline. We would encourage you to contact us on the date of departure if you wish us to keep the return flight open; this decision remains at the discretion of the airline company.

Flight Connections

If any booked flight connecting with your outbound or inbound flight is cancelled or delayed, the airlines reserve the right to provide that transport by any other means (coach/bus, train, etc.).  If you organize your own connecting transport with the arrangements booked with Expensify, we would advise that you reserve flexible or refundable tickets in order to avoid the risk of any financial loss.  You are also advised not to make any important appointments upon or for the day following your return date. Expensify cannot accept responsibility for the consequences of delays (such as a cancelled scheduled flight) in the context of connecting transport organized by you.

Non-Use of Flight Segments

You agree not to purchase a ticket or tickets containing flight segments that you will not be using, such as a “point-beyond”, “hidden-city”, or “back-to-back tickets”. You further agree not to purchase a round-trip ticket that you plan to use only for one-way travel. You acknowledge that the airlines generally prohibit all such tickets, and therefore we do not guarantee that the airline will honor your ticket or tickets. You agree to indemnify Expensify against any airline claims for the difference between the full fare of your actual itinerary and the value of the ticket or tickets that you purchased.

Luggage

Expensify assumes no liability for any loss or damage to baggage or personal effects, whether in transit to or from a Trip, or during a Trip.   In the event of damage, late forwarding, theft or loss of luggage, you should contact the airline and declare the damage, absence or loss of your personal effects before leaving the airport, and then submit a declaration, attaching the originals of the following documents: the travel ticket, the baggage check-in slip, and the declaration.  It is recommended that you take out an insurance policy covering the value of any personal items.

Additional and oversized baggage fees: Most airlines have their own policy regarding luggage.  We recommend that you check with the airline ahead of time for any weight or size restrictions and additional charges relating to checked baggage. You will be responsible for paying to the airline any additional charges for checked or overweight baggage, including, but not limited to, golf bags and oversized luggage.  If baggage exceeds the weight limit set by the airline, and excess weight is permitted, any supplement will be paid directly to the airline at the airport. 

Carriage of Hazardous Material

Federal law forbids the carriage of hazardous materials aboard aircraft in your luggage or on your person. A violation can result in five years’ imprisonment and penalties of $250,000 or more.  Hazardous materials include explosives, compressed gases, flammable liquids and solids, oxidizers, poisons, corrosives and radioactive materials. Examples: Paints, lighter fluid, fireworks, tear gases, oxygen bottles, and radio-pharmaceuticals. There are special exceptions for small quantities (up to 70 ounces total) of medicinal and toilet articles carried in Traveler’s luggage and certain smoking materials carried on Traveler’s person.

Pregnancy

Different airlines have their own restrictions on when pregnant women may fly on their planes. It is your responsibility to check the restrictions of your particular airline. If Traveler is denied boarding, Expensify will not be responsible for any resulting cancellation fees and charges.

Stop-Overs

Direct flights may be “non-stop” or may involve one or more stop-overs (in the latter case this means the same flight by the airline, because the flight number remains the same).  The same applies to connecting flights that may be subject to crew changes.  When you reserve a scheduled or charter flight involving a stop-over in a town, and the second flight takes off from a different airport to the airport of arrival, ensure that you have sufficient time for reaching the second airport.  The journey to the other airport is at your own expense.  Expensify will not be able to reimburse you for these costs, nor will it be liable if Traveler misses the second flight.

15. Local Customs, Laws, and Travel Risks

Travelers may be traveling to foreign countries, with different customs, standards, laws and risks than those Travelers are accustomed to. You understand that you must be prepared to cope with the unexpected, with local customs and shortages, with the vagaries of weather, travel and mankind in general. As such, you acknowledge and accept the risks associated with travel in a foreign country and agree to release and hold Expensify harmless for any such problems experienced on the Trip.

Travel to certain areas may involve greater risk than others. You assume sole responsibility for Traveler’s own safety at any destination traveled to.  Expensify does not guarantee Traveler’s safety at any time and assumes no responsibility for gathering and/or disseminating information for you relating to risks associated with your destinations.  BY OFFERING OR FACILITATING TRAVEL TO CERTAIN DESTINATIONS, WE DO NOT REPRESENT OR WARRANT THAT TRAVEL TO SUCH POINTS IS ADVISABLE OR WITHOUT RISK, AND WE SHALL NOT BE LIABLE FOR DAMAGES OR LOSSES THAT MAY RESULT FROM TRAVEL TO SUCH DESTINATIONS.

16. Disclaimer of Warranties

The inclusion or offering of any Virtual Assistant Services by Expensify does not constitute any endorsement or recommendation of such products or services. UNLESS OTHERWISE STATED, ALL GOODS AND SERVICES OFFERED BY EXPENSIFY ARE PROVIDED TO YOU ON AN “AS-IS,” “AS AVAILABLE” BASIS.

TO THE FULLEST EXTENT PERMISSIBLE PURSUANT TO APPLICABLE LAW, EXPENSIFY DISCLAIMS ALL REPRESENTATIONS AND WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, SUITABILITY FOR A PARTICULAR PURPOSE, TITLE, UNINTERRUPTED SERVICE, AND ANY WARRANTIES ARISING OUT OF A COURSE OF PERFORMANCE, DEALING OR TRADE USAGE FOR ALL GOODS AND SERVICES SOLD BY/THROUGH EXPENSIFY. Applicable law in your jurisdiction may not allow the exclusion of implied warranties, so the above exclusions may not apply to you.

EXPENSIFY DOES NOT MAKE ANY WARRANTY AS TO THE RESULTS THAT MAY BE OBTAINED FROM THE USE OF CONCIERGE AI OR THE ACCURACY OF ANY OTHER INFORMATION OBTAINED THROUGH CONCIERGE AI. YOU UNDERSTAND AND AGREE THAT ANY MATERIAL AND/OR DATA OBTAINED THROUGH THE USE OF ANY CONCIERGE AI FEATURE IS DONE AT YOUR SOLE RISK. YOU SHOULD NOT RELY ON FACTUAL ASSERTIONS IN OUTPUT WITHOUT INDEPENDENTLY FACT CHECKING THEIR ACCURACY. OUTPUT THAT APPEAR ACCURATE BECAUSE OF THEIR DETAIL OF SPECIFICITY MAY STILL CONTAIN MATERIAL INACCURACIES. CONCIERGE AI CANNOT DYNAMICALLY RETRIEVE INFORMATION, AND OUTPUT MAY NOT ACCOUNT FOR EVENTS OR CHANGES TO UNDERLYING FACTS OCCURRING AFTER THE AI MODEL WAS TRAINED. NO INFORMATION OR ADVICE, WHETHER ORAL OR WRITTEN, OBTAINED BY YOU FROM EXPENSIFY OR THROUGH CONCIERGE AI SHALL CREATE ANY WARRANTY NOT EXPRESSLY MADE HEREIN.

17. Force Majeure

Expensify shall not be responsible for failure to perform any of its obligations under these Concierge Terms during any period in which such performance is prevented or delayed due to Force Majeure.  ”Force Majeure” refers to any event beyond Expensify’s reasonable control, including but not limited to severe weather, fire, flood, mudslides, earthquakes, war, labor disputes, strikes, political unrest, natural or nuclear disaster, pandemics or epidemics, World Health Organization’s advisories and/or alerts, Center for Disease Control’s advisories and/or alerts, U.S. State Department’s advisories and/or alerts, any order of any local, provincial or federal government authority, interruption of power Services, terrorism or any other causes beyond the control of Expensify or deemed by Expensify to constitute a danger to the safety and well-being of Travelers.  Expensify reserves the right to cancel any Virtual Assistant Services due to Force Majeure.

18. Compliance

If you believe that Expensify has not adhered to these Concierge Terms, please contact Expensify by emailing us at: concierge@Expensify.com. We will do our best to address your concerns. If you feel that your concerns have been addressed incompletely, we invite you to let us know for further investigation. If you choose to use Concierge, you may not use it in a manner that violates any OpenAI Policy.

19. Severability and Survivability

If any provision, or portion of a provision, in these Concierge Terms shall be unlawful, void, or for any reason unenforceable, then that provision shall be deemed severable and shall not affect the validity and enforceability of any remaining provisions. You and Expensify agree to substitute for such provision a valid provision which most closely approximates the intent and economic effect of such severed provision.

Notwithstanding any other provisions of these Concierge Terms, or any general legal principles to the contrary, any provision of these Concierge Terms that imposes or contemplates continuing obligations on a party will survive the expiration or termination of these Concierge Terms.
